Statutory right of withdrawal

Aava Art’s workshops are leisure services (cultural and recreational services) booked for a specific date and time. Under Chapter 6, Section 16 of the Finnish Consumer Protection Act, the 14-day right of withdrawal for distance selling does not apply to such services. Cancellations are governed by Aava Art’s own booking and cancellation terms, set out below.

Private customers

If your order includes a venue, catering or other third-party services arranged by Aava Art, the terms under Event packages for private customers apply.

Payment and booking confirmation

Open evenings: Payment is made at the time of booking, and the booking is confirmed once payment has been made.

Group bookings: A booking is binding once Aava Art has confirmed it in writing by email. Aava Art sends an invoice when the booking is made. Payment must be made no later than 14 days before the workshop. If the invoice is not paid by the due date, Aava Art has the right to cancel the booking, in which case the portion of the price that is non-refundable under the cancellation terms will be invoiced.

Workshops at the customer’s premises

When a workshop is held at a space designated by the customer, the customer is responsible for ensuring that the space is suitable for painting and available at the agreed time. The space must have enough tables and chairs for the group, a water supply, adequate lighting, a power socket and clear access for bringing in equipment. The space must be available at least one hour before the workshop and for about one hour afterwards for setting up and packing away.

The customer must inform us in advance of any particularly delicate surfaces, furniture, textiles or other materials that should be protected or moved. Aava Art cannot be held responsible for the adequacy of protection for items it has not been informed of.

If the space does not correspond to what was agreed, the workshop will be carried out as far as conditions allow. Time spent remedying any shortcomings will not extend the workshop. If you are unsure whether a space is suitable, please contact us in advance and we will look at it together before you book.

Aava Art protects the work area before starting, works carefully and tidies the work area after the workshop. Aava Art holds valid public liability insurance and is liable for damage caused by its own negligence in accordance with the terms of the insurance. Please report any damage as soon as possible.

Aava Art is not liable for damage caused by a participant’s own negligence or failure to follow instructions. Participants take part at their own risk and are responsible for their own clothing and belongings. The workshops use paints and other colourants that may not wash out of fabric. Protective aprons are included, but we recommend wearing clothes that can withstand splashes and stains.

Payment methods

Payments are made using the payment methods offered by Paytrail and MobilePay. These methods allow you to purchase several places.

ePassi and Edenred Virike are personal payment methods. A maximum of one (1) place per workshop can be purchased with each payment method. If more than one place in the same workshop has been purchased with a culture or sport benefit, Aava Art reserves the right to cancel the extra places and refund the corresponding amount to the original payment method. Any costs, penalties or recovery costs arising from misuse of a personal payment method are solely the customer’s responsibility.

Refunds

Refunds are made to the original payment method. Refunds for payments made with culture and sport benefits (ePassi, Edenred) are returned to the user’s balance in accordance with the provider’s policy.

Number of participants and changes: group bookings

The minimum price of a group booking is always binding, regardless of the actual number of participants.

Participants can be added by emailing info@aavaart.fi no later than 14 days before the workshop, subject to Aava Art’s capacity and rules. Later additions can be requested separately but cannot be guaranteed.

Cancellations: open evenings

Cancellations must be made by email to info@aavaart.fi.

More than 14 days before the workshop: Full refund.

7–14 days before the workshop: 50% refund, or your place can be moved to another open evening in accordance with Aava Art’s rules. A place can be moved once.

Less than 7 days before the workshop: No refund. Your place can be transferred to another person or moved to another open evening by notifying info@aavaart.fi. In 18+ workshops, the age and participation requirements apply, and a place cannot be transferred to a minor or to anyone otherwise ineligible. A place can be transferred once.

No-show: No refund and no option to transfer.

Cancellations: group bookings

Cancellations must be made by email to info@aavaart.fi.

More than 14 days before the workshop: Full refund or rescheduling to another date. A booking can be rescheduled once.

7–14 days before the workshop: 50% refund.

Less than 7 days before the workshop: No refund.

No-show: No refund and no option to reschedule.

Late arrival

The workshop start time is binding. Late arrivals may still join, but the workshop ends as agreed and no extra time is given.

Pregnant participants

Before booking, please check whether your chosen workshop is suitable during pregnancy. We recommend watercolour, gouache and drawing techniques (charcoal, pencil) for pregnant participants. Acrylic paints, alcohol inks and oil paints are not suitable during pregnancy. Participation is always at your own risk, and if in doubt, we recommend consulting a healthcare professional before taking part.

Refusal of entry without refund

Aava Art checks the identity of all participants in 18+ workshops before the workshop begins. Acceptable proof of identity is an official photo ID that clearly shows the date of birth, such as a passport, identity card or driving licence.

In the following situations, entry will be refused and no refund will be given.

In all workshops:

  • The participant has a valid ban from Aava Art events
  • The participant is clearly intoxicated on arrival
  • The participant otherwise breaches Aava Art’s participation or safety terms

Additionally, in 18+ workshops:

  • The participant is under 18
  • No proof of identity is presented, or it does not match the details provided

Aava Art also reserves the right to refuse entry on other justified grounds of safety or order.

Removal from the event

Aava Art has the right to remove a participant during the workshop without a refund in the following situations:

  • Disruptive or inappropriate behaviour towards other participants, the model or the instructor
  • Intoxication to the extent that it disturbs others or endangers safety
  • Conduct that endangers safety
  • Breaching the ban on photography and filming in 18+ workshops (Art undressed/croquis)
  • Harming or attempting to harm other participants, the model or the instructor, or damaging or attempting to damage Aava Art’s property
  • Repeated or deliberate breaches of Aava Art’s rules

Removal may result in a permanent ban from all Aava Art events.

Force majeure

Aava Art: If an open evening or group workshop is cancelled for reasons attributable to Aava Art or due to force majeure, we will inform you as soon as possible. You can move your place to another date or receive a full refund.

Customer: In the event of an unexpected and serious life situation, moving your place to another date may be considered on a case-by-case basis. Please contact info@aavaart.fi as soon as possible.

Disputes

We aim to resolve any disagreements primarily by mutual agreement. Please contact us and we will look into the matter. If no solution is found, you can contact the Consumer Advisory Services (kuluttajaneuvonta.fi) and refer the matter to the Consumer Disputes Board (kuluttajariita.fi). These terms are governed by Finnish law.

Event packages for private customers

An event package is an order in which Aava Art arranges a venue and catering at a partner restaurant in addition to the art workshop, and invoices everything as a single package. The terms below apply to these orders.

All other sections of these terms also apply to event packages, in particular Late arrival, Pregnant participants, Refusal of entry without refund and Removal from the event. The age and identity requirements of 18+ workshops also apply to event packages.

Quote

The quote is based on the number of people, date and restaurant given at the time of ordering, and is valid until the date stated in the quote.

Prices are based on the partner restaurant’s prices at the time of the quote. If these change before the order is confirmed, we will let you know before confirmation.

Booking and payment

Orders are confirmed by email. We book the venue and catering immediately after confirmation and keep the date reserved.

The invoice must be paid no later than 21 days before the event.

  • If the event is more than 35 days away, the payment term is 14 days.
  • If the event is 21–35 days away, the payment term is shorter and the due date is 21 days before the event.
  • If the event is less than 21 days away, payment terms are agreed separately and payment must be made before the event.

The due date is always shown on the invoice.

If the invoice has not been paid by the due date, Aava Art has the right to cancel the booking. In this case, a cancellation fee in accordance with the cancellation terms will be charged, together with any non-refundable third-party costs.

Late payment of invoices sent after the event, such as for drinks, changes and additional participants, will incur late payment interest under the Finnish Interest Act and collection costs in accordance with the Finnish Debt Collection Act. The same late payment consequences apply to cancellation and change fees.

If, exceptionally, the restaurant is unable to host the event, we will arrange an equivalent venue for the same day or agree on a new date with you at no extra cost.

Number of participants

The final number of participants must be confirmed no later than 21 days before the event and may differ from the number given at the time of ordering by no more than two people. For a larger change, we will prepare a new quote.

Invoicing is based on the confirmed number of participants. Reductions notified after this are not refunded, as the venue and catering have been ordered according to the confirmed number.

Dietary requirements and requests

Allergies, dietary requirements and requests for the workshop theme must be notified no later than 21 days before the event.

Dietary requirements notified later cannot be guaranteed, but we will do our best to accommodate them. If the restaurant charges extra for them, the cost will be added to the invoice.

We pass the information on to the restaurant but are not responsible for the restaurant’s service or ingredient information.

Changes after the deadline

We do our best to accommodate late requests too. However, changes made after the deadline require new arrangements with the restaurant, so a €50 handling fee is charged for them. The cost of the change itself is also invoiced if the change goes ahead.

The handling fee is also charged if the change cannot be made for reasons attributable to the restaurant, as the work of looking into it has already been done.

Changes notified in the same message are treated as a single change request, so please combine your requests into one message whenever possible.

Drinks

Alcoholic drinks are purchased and served by the restaurant under its own alcohol licence and within its own licensed area. Aava Art does not sell or serve alcohol.

Drinks are included in the package price and are invoiced after the event according to actual consumption, with a payment term of 14 days. The drinks estimate given in the quote is indicative.

Bringing your own alcoholic drinks into the restaurant is not permitted.

Cancellations

Cancellations must be made in writing by email.

More than 21 days before the event: The cancellation fee is €150 or 10% of the total order price, whichever is greater, plus any non-refundable costs incurred by the restaurant. Any remaining amount paid will be refunded.

14–21 days before the event: The cancellation fee is 50% of the total order price, plus any non-refundable costs incurred by the restaurant. Any remaining amount paid will be refunded.

Less than 14 days before the event: 100% of the price will be invoiced.

No-show: 100% of the price will be invoiced.

For events in November and December, the cancellation deadlines are 60 and 30 days:

More than 60 days before the event: The cancellation fee is €150 or 10% of the total order price, whichever is greater, plus any non-refundable costs incurred by the restaurant.

30–60 days before the event: The cancellation fee is 50% of the total order price, plus any non-refundable costs incurred by the restaurant.

Less than 30 days before the event: 100% of the price will be invoiced.

The cancellation fee covers the work involved in preparing the order: drawing up the quote, booking the venue and catering, planning the schedule and invoicing.

Any amount already paid is deducted from the cancellation fee. If the amount paid exceeds the cancellation fee, the difference will be refunded. If the cancellation fee exceeds the amount paid, the difference will be invoiced.

Rescheduling

An event can be rescheduled once, provided the restaurant is able to host it on the new date. A rescheduling fee of €150 is charged, plus any change fees charged by the restaurant. The cancellation terms of a rescheduled booking are calculated from the new date.

If prices for the new date differ from the original prices, the difference will be invoiced or refunded.

If rescheduling is due to Aava Art or the restaurant, no rescheduling fee is charged.

Responsibility for the venue and catering

The venue and catering are provided by the restaurant as its own service and under its own responsibility. Aava Art acts as the organiser: we book the venue and catering, pass on information and coordinate the schedule. Aava Art is responsible for the art workshop it provides, its materials and its instructors.

If there are shortcomings in the restaurant’s service, we will pass the matter on to the restaurant without delay and help resolve it.

The restaurant’s own house rules and safety regulations apply at the event.

Attendance

The event follows the agreed schedule. If a participant arrives late, leaves early or does not attend at all, the full price still applies, as the venue, catering, materials and instructors have been reserved for the whole group.

Force majeure

If the event is cancelled due to force majeure, we will primarily offer a new date. If this is not possible, the amount paid will be refunded.

Force majeure means an unforeseeable event beyond the control of the parties that could not have been taken into account when the agreement was made and that prevents the event from taking place. Examples include natural disasters, fire, epidemics, strikes, interruptions to electricity or water supply, orders from the authorities and the premises becoming unusable.

Disputes

We aim to resolve any disagreements primarily by mutual agreement. Please contact us and we will look into the matter. If no solution is found, you can contact the Consumer Advisory Services (kuluttajaneuvonta.fi) and refer the matter to the Consumer Disputes Board (kuluttajariita.fi). These terms are governed by Finnish law.

Payment service provider

Paytrail Plc (Business ID 2122839-7) acts as the payment intermediary and payment service provider, in cooperation with Finnish banks and credit institutions. Paytrail Plc appears as the payee on your bank statement or card bill and forwards the payment to the merchant. Paytrail Plc holds a payment institution licence. In the event of a complaint, please contact the supplier of the product first.

Businesses

The invoice must be paid no later than 21 days before the workshop. Bookings made at shorter notice are agreed separately at info@aavaart.fi.

If the invoice is not paid by the due date, Aava Art has the right to cancel the booking, in which case a cancellation fee in accordance with the cancellation terms will be invoiced.

Refunds

Refunds are made to the original payment method.

Number of participants and changes

Workshops at the client’s premises

When a workshop is held at premises designated by the client, the client is responsible for ensuring that the premises are suitable for painting and available at the agreed time. The space must have enough tables and chairs for the group, a water supply, adequate lighting, a power socket and clear access for bringing in equipment. The space must be available at least one hour before the workshop and at least one hour afterwards for setting up and packing away.

The client must inform Aava Art in advance of any particularly delicate surfaces, furniture, textiles or other materials that should be protected or moved. Aava Art cannot be held responsible for the adequacy of protection for items it has not been informed of.

If the premises do not correspond to what was agreed, the workshop will be carried out as far as conditions allow. Time spent remedying any shortcomings will not extend the workshop, and a resulting shortened or modified workshop does not entitle the client to a refund. If the workshop cannot take place at all due to shortcomings in the premises, the cancellation terms apply.

Aava Art protects the work area before starting, works carefully and tidies the work area after the workshop. Aava Art holds valid public liability insurance and is liable for damage caused by its own negligence in accordance with the terms and limits of the insurance policy. Any damage must be reported to Aava Art in writing without delay and no later than 7 days after the workshop.

Aava Art is not liable for damage caused by a participant’s own negligence, failure to follow instructions or inadequate conditions at the premises. Nor is Aava Art liable for indirect losses, such as loss of profit or other business interruption.

Participants take part at their own risk and are responsible for their own clothing and belongings. The workshops use paints and other colourants that may not wash out of fabric. Protective aprons are included, but we recommend wearing clothes that can withstand splashes and stains.

Cancellations

Cancellations must be made in writing to info@aavaart.fi.

More than 30 days before the workshop: Full refund or rescheduling to another date.

14–30 days before the workshop: The cancellation fee is 50% of the agreed total price. Rescheduling may be possible on a case-by-case basis: please contact info@aavaart.fi.

Less than 14 days before the workshop: 100% of the price will be invoiced. Rescheduling may be possible on a case-by-case basis: please contact info@aavaart.fi.

No-show: 100% of the price will be invoiced, with no option to reschedule.

A booking can only be rescheduled once and within Aava Art’s schedule. The cancellation terms of a rescheduled booking are calculated from the new date. A rescheduled booking cannot be rescheduled again.

  • Conduct that endangers safety
  • Breaching the ban on photography and filming in 18+ workshops
  • Harming or attempting to harm other participants, the model or the instructor, or damaging or attempting to damage Aava Art’s property
  • Repeated or deliberate breaches of Aava Art’s rules

Removal may result in a permanent ban from all Aava Art events.

Force majeure

Aava Art: If a workshop is cancelled due to an unforeseen reason attributable to Aava Art or due to force majeure, we will primarily offer to reschedule. If rescheduling is not possible, a full refund will be given.

Client: In the event of an unexpected and serious situation, please contact info@aavaart.fi without delay. Each case is considered individually.

Disputes

The parties will primarily seek to resolve any disagreements through negotiation. If no agreement is reached, the dispute will be settled in the Oulu District Court. These terms are governed by Finnish law.

Event packages for businesses

An event package is an order in which Aava Art arranges a venue, catering or other third-party services in addition to the art workshop and invoices them as part of the whole.

The terms in this section apply to these orders. In all other respects, the terms in the Businesses section apply. The section Workshops at the client’s premises does not apply to event packages.

Prices stated in this section exclude VAT. The terms in force at the time of ordering apply to the order.

All other sections of these terms also apply to event packages, in particular Late arrival, Pregnant participants, Refusal of entry without refund and Removal from the event. The age and identity requirements of 18+ workshops also apply to event packages.

Quote and prices

The quote is based on the number of people, date and venue given at the time of ordering. The quote is valid until the date stated in it.

The prices in the quote are based on our partners’ prices in force at the time of the quote. If a partner’s price changes before the order is confirmed, Aava Art will update the quote and inform the client before confirmation.

Aava Art books the venue and catering immediately after the order is confirmed and keeps the date reserved for the client. If, exceptionally, the venue is not available, Aava Art will arrange an equivalent venue for the same day or agree a new date with the client at no extra cost.

Order confirmation and payment

Orders are confirmed in writing by email. An accepted quote constitutes a binding agreement between the parties. Aava Art sends an order confirmation and an advance invoice.

Event packages are invoiced in advance, as Aava Art books the venue and catering on the client’s behalf and commits to them before the event. Depending on the package, the advance invoice covers 80% or 100% of the order price. Any remaining balance is invoiced after the event.

The advance invoice must be paid no later than 21 days before the event.

  • If the event is more than 35 days away, the payment term is 14 days.
  • If the event is 21–35 days away, the payment term is shorter and the due date is 21 days before the event.
  • If the event is less than 21 days away, payment terms are agreed separately and payment must be made before the event.

The due date is always shown on the invoice.

If the advance invoice has not been paid by the due date, Aava Art has the right to cancel the booking. In this case, a cancellation fee in accordance with the cancellation terms will be charged, together with any non-refundable third-party costs.

Late payment of invoices sent after the event, such as for the remaining balance, drinks, changes and additional participants, will incur late payment interest under the Finnish Interest Act and a fixed €40 compensation for collection costs under Finnish law. Any further collection costs will be invoiced separately. The same late payment consequences apply to cancellation and change fees.

Number of participants

The final number of participants must be confirmed no later than 21 days before the event. The confirmed number may differ from the number given at the time of ordering by no more than two people. A larger change requires a new quote.

Invoicing is based on the number confirmed 21 days before the event. Reductions notified after this are not refunded, as the venue and catering have been ordered according to the confirmed number.

Changes after the deadline

We do our best to accommodate late requests too. However, changes made after the deadline require additional work and new arrangements with our partners, so they are charged separately.

Changes after the 21-day deadline include, for example, adding participants, adding or changing catering, changes to the schedule and other additions to the order.

A change requires that the venue and restaurant are able to accommodate it. Aava Art will look into it and let the client know whether the change is possible and what it will cost.

The following are charged for changes:

  • A €50 handling fee per change request, covering the work with our partners
  • The services affected by the change, according to our price list or the partner’s price, if the change goes ahead

The handling fee is also charged if the change is not possible for reasons attributable to a partner, as the work has already been done. Aava Art cannot guarantee a third party’s consent but will always try to find a solution.

Changes notified in the same message are treated as a single change request, so please combine your requests into one message whenever possible.

Changes are invoiced separately. If a change concerns items invoiced according to actual consumption, they are invoiced after the event.

Dietary requirements and requests

Allergies, dietary requirements and requests for the workshop theme must be notified to the contact person for the order no later than 21 days before the event.

Dietary requirements notified later cannot be guaranteed, but we will do our best to accommodate them. If the restaurant charges extra for them, the cost will be invoiced to the client.

Aava Art passes the information on to the restaurant but is not responsible for the restaurant’s service or ingredient information.

Drinks

Alcoholic drinks are purchased and served by the holder of the venue’s alcohol licence within its own licensed area, and the licence holder is responsible for them. Aava Art does not sell or serve alcohol.

Ownership of the drinks passes directly from the licence holder to the client. Aava Art does not buy, own or resell alcoholic drinks, but invoices the service as a whole.

The licence holder has a statutory obligation not to serve alcohol to anyone who is intoxicated or under age, and may stop serving. Stopping service does not entitle the client to a refund.

Drinks are included in the total price of the order and are not itemised separately on the invoice.

Drinks are invoiced after the event according to actual consumption, with a payment term of 14 days. The drinks estimate given in the quote is indicative, not a fixed drinks package.

Bringing your own alcoholic drinks to the venue is not permitted. The Finnish Alcohol Act prohibits consuming alcoholic drinks in restaurants and other places where food or refreshments are available to the public for a charge, unless the drinks are served by the licence holder.

Non-alcoholic drinks are included in the order in the same way.

Cancellations

Cancellations must be made in writing by email to the contact person for the order.

More than 21 days before the event: The cancellation fee is €150 or 10% of the total order price, whichever is greater, plus the non-refundable third-party costs described below. Any remaining amount paid will be refunded.

14–21 days before the event: The cancellation fee is 50% of the total order price, plus any non-refundable costs incurred by the restaurant. Any remaining amount paid will be refunded.

Less than 14 days before the event: 100% of the price will be invoiced.

No-show: 100% of the price will be invoiced.

Stricter cancellation terms apply to events in November and December:

More than 60 days before the event: The cancellation fee is €150 or 10% of the total order price, whichever is greater, plus the non-refundable third-party costs described below. Any remaining amount paid will be refunded.

30–60 days before the event: The cancellation fee is 50% of the total order price, plus the non-refundable third-party costs described below. Any remaining amount paid will be refunded.

Less than 30 days before the event: 100% of the price will be invoiced.

The cancellation fee covers the work involved in preparing the order: drawing up the quote, booking the venue and catering, planning the schedule and invoicing.

Any amount already paid is deducted from the cancellation fee. If the amount paid exceeds the cancellation fee, the difference will be refunded to the client. If the cancellation fee exceeds the amount paid, the difference will be invoiced.

Third-party costs

Change, cancellation and handling fees charged by third parties are invoiced to the client at cost.

Likewise, third-party costs that cannot be cancelled or refunded at the time of cancellation are invoiced, even if the cancellation is made within a period that is otherwise free of charge.

Rescheduling

Rescheduling may be possible on a case-by-case basis, provided the venue and restaurant are able to host the event on the new date. An event can only be rescheduled once. The cancellation terms of a rescheduled booking are calculated from the new date.

A rescheduling fee of €150 or 10% of the total order price, whichever is greater, is charged, as the venue, catering and instructor arrangements must be made again. Any change and cancellation fees charged by third parties are also invoiced.

If prices for the new date differ from the original prices, the difference will be invoiced to or refunded to the client.

If rescheduling is due to Aava Art or to the venue or restaurant, no rescheduling fee is charged.

Venue and catering

The venue and catering are provided by the venue or restaurant concerned as its own service and under its own responsibility. For these, Aava Art acts as the organiser: it books the venue and catering on the client’s behalf, passes on information and coordinates schedules.

Aava Art is responsible for the art workshop it provides, its materials and its instructors.

Aava Art is not responsible for the quality, content, delay or interruption of the service provided by the venue or restaurant. If there are shortcomings in the service, Aava Art will pass the matter on to the service provider without delay and assist in resolving it.

The venue’s own house rules and safety regulations apply at the event. The client is responsible for any damage caused to the venue by participants in accordance with the venue’s own terms.

Unavailability on Aava Art’s side

If an instructor is unable to attend due to illness or another unforeseeable reason, Aava Art will arrange a substitute. If no substitute is available, we will offer to reschedule without a rescheduling fee or refund the art workshop portion in full.

Attendance

The event follows the agreed schedule. If a participant arrives late, leaves early or does not attend at all, the full price still applies, as the venue, catering, materials and instructors have been reserved for the whole group.

Complaints

Any complaints about how the event was carried out must be made in writing within 21 days of the event.

Force majeure and limitation of liability

Force majeure means an unforeseeable event beyond the control of the parties that could not have been taken into account when the agreement was made and that prevents the event from taking place. Examples include natural disasters, fire, epidemics, strikes, interruptions to electricity or water supply, orders from the authorities and the premises becoming unusable.

If the venue or restaurant cancels the event for reasons of its own or due to force majeure, Aava Art will primarily try to arrange an equivalent venue and catering for the same date. If this is not possible, we will offer to reschedule or refund the amount paid in full.

Aava Art is not liable for indirect losses incurred by the client, such as travel costs, loss of working time or other business interruption.

Aava Art’s liability for an event package is in all cases limited to the total price of the order.

Disputes

The parties will primarily seek to resolve any disagreements through negotiation. If no agreement is reached, the dispute will be settled in the Oulu District Court. These terms are governed by Finnish law.
